These Terms of Service ("Terms") govern your access to and use of the website FlightsTo.xyz (the "Site") operated by Brothers IT Yazılım Arge ve Bilişim Hizmetleri Tic. San. Ltd. Şti. ("Brothers IT", "we", "us", or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. The service

The Site provides informational content and tools to compare indicative flight prices and discover travel offers. We may display links to third-party booking providers, affiliate networks, or advertisers. We do not issue airline tickets and we are not a party to any contract between you and an airline or travel seller.

2. No professional advice

Content on the Site is for general information only. It is not legal, financial, tax, health, or travel advice. Always confirm visa, health, insurance, and entry requirements with official sources before you travel.

3. Accuracy and availability of prices

Fares, taxes, fees, schedules, and seat availability change frequently. Third-party providers may show different prices than those displayed on the Site. We do not warrant that any price, route, or schedule shown on the Site is current, complete, or available for purchase.

4. Third-party websites and advertising

The Site may contain links to third-party websites, advertisements, and measurement technologies operated by partners (including, for example, Google and Microsoft advertising products where enabled). Your use of third-party services is governed solely by those third parties' terms and privacy policies. We are not responsible for third-party content, pricing, or conduct.

5. Acceptable use

You agree not to:

  • Violate applicable law or third-party rights.
  • Attempt to gain unauthorised access to our systems, scrape the Site in a way that harms performance, or circumvent technical limits.
  • Use the Site to distribute malware, spam, or misleading or unlawful content.
  • Misrepresent your affiliation with us or impersonate another person or entity.

The Site's branding, layout, text, graphics, and software are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Site without our prior written consent, except as allowed by mandatory law.

7. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BROTHERS IT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THIRD-PARTY SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY FOR THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO) OR (B) ONE HUNDRED US DOLLARS (USD 100), UNLESS MANDATORY LAW REQUIRES OTHERWISE.

9. Indemnity

You will defend, indemnify, and hold harmless Brothers IT from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site or violation of these Terms, to the extent permitted by law.

10. Suspension and termination

We may suspend or discontinue the Site, or restrict your access, at any time for operational, legal, or security reasons, without liability to you.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules that would require application of another jurisdiction's laws, except where mandatory consumer protections in your country cannot be waived.

Subject to mandatory law, exclusive jurisdiction for disputes arising from or relating to these Terms or the Site shall lie with the courts and enforcement offices of Sakarya, Türkiye.
